1) Services & IMPORTANT HEALTH NOTICE

ManeMap is an app designed to help organize horse care. ManeMap does not provide veterinary medical advice. The information provided by the app and its AI assistant, Milo, is for organizational support and general informational purposes only. It is in no way a substitute for professional veterinary diagnosis, treatment, or medication. Never disregard professional veterinary advice because of information you have read on this app. In the event of an emergency, please contact a veterinary clinic or your veterinarian immediately.

2) User Accounts

You agree to provide accurate and truthful information. Please keep your login credentials strictly confidential. In the event of any violations, we reserve the right to temporarily suspend or permanently terminate your account.

3) Acceptable Use

It is prohibited to upload or share content that is unlawful, infringes on intellectual property rights, violates personal rights, image rights, or data protection laws, is misleading or harmful, or contains malware. If you upload personal data of third parties (e.g., individuals in photos), you must have the appropriate legal basis or consent. We are authorized to block access to obviously illegal content and provide the reasons for doing so, in accordance with applicable laws (Art. 17 DSA – “Statement of Reasons”).

4) User Content & Licensing

You retain all rights to the content you upload. You grant ManeMap a non-exclusive, revocable, worldwide license to host, process, display, transmit, and back up your content solely for the purpose of providing and securing the service. You also authorize us to transmit your content to the recipients of your choice (e.g., your veterinary clinic). The recipients you select act as independent data controllers (under data protection law) with respect to the copies they receive.

5) Moderation & Reporting under the DSA (Digital Services Act)

• No general monitoring obligation: We are under no general obligation to monitor or investigate content. However, we will take action as soon as we obtain actual knowledge of illegal content or receive official orders (Art. 8–10 DSA).

• Notice and Action Process (Art. 16 DSA): Please use our contact form at manemap.app/contact or email us at info@manemap.app. We carefully review all reports and provide statements of reasons in accordance with Art. 17 DSA. Repeated misuse may lead to measures pursuant to Art. 23 DSA.

• Official Orders: We comply with legally binding orders to act against specific content or to provide information (Art. 9–10 DSA) and will notify the affected users when required.

6) App Stores & Subscriptions

Subscriptions are billed through the respective app store (Apple/Google) and renew automatically unless canceled in your store settings. Prices and scope of services are displayed directly on the app.

7) Right of Withdrawal (for Consumers)

You have a statutory 14-day right of withdrawal in accordance with §§ 312g, 355 of the German Civil Code (BGB). For digital content or digital services, this right of withdrawal may expire prematurely if you (i) expressly consent to the immediate performance of the contract and (ii) acknowledge that you will lose your right of withdrawal once performance has begun (details can be found in the separate “Cancellation Policy”).

8) Warranty & Liability

We are fully liable for intent, gross negligence, injury to life, limb, or health, and under the Product Liability Act. In cases of ordinary negligence, we are only liable for the breach of essential contractual duties (cardinal obligations), limited to the foreseeable damage typical for this type of contract.

9) Data Privacy

Your use of our service is also subject to our Privacy Policy.

10) Governing Law & Jurisdiction

German law applies; mandatory consumer protection regulations of the country of your habitual residence remain unaffected. For business merchants, the place of jurisdiction is our registered company seat.

11) Changes to these Terms

We reserve the right to update these Terms of Use within reasonable limits and will notify you of any changes in advance. You may object to the changes prior to them taking effect or terminate the contract.
