1) Service & IMPORTANT HEALTH WARNING

ManeMap is an app for organizing horse care. ManeMap is not veterinary advice. The information provided by the app or the AI assistant “Milo” is intended solely to support organization and provide general information. It is in no way a substitute for professional diagnosis, treatment, or medication by a veterinarian. Never ignore professional veterinary advice because of information from this app. In an emergency, contact a veterinary clinic immediately.

2) Accounts

Please provide truthful information. Keep your login credentials confidential. We may suspend or terminate accounts in the event of violations.

3) Acceptable Use

You may not upload or share content that is unlawful, infringes intellectual property rights, violates personality/image rights or privacy, is deceptive or harmful, or contains malware. If you upload personal data of third parties (e.g., people in photos), you must have a lawful basis/permission to do so. We may disable access to manifestly unlawful content and explain the reasons for doing so, insofar as required by law (Art. 17 DSA – “Statement of Reasons”). EUR-Lex+1

4) User Content & License

You retain your rights to the content you upload. You grant ManeMap a non-exclusive, revocable, worldwide license to host, process, display, transmit, and back up your content solely for the purpose of providing and securing the service. You also authorize us to transmit your content to recipients selected by you (e.g., your veterinary practice). The recipients you select act as independent controllers with respect to the copies they receive.

5) Moderation & DSA Notices

No general monitoring: We are not subject to any general obligation to monitor or investigate, but we will act as soon as we obtain actual knowledge of unlawful content or receive official orders (Arts. 8–10 DSA). cms-digitallaws.com

Official orders: We comply with valid orders to act against content or to provide information (Arts. 9–10 DSA) and inform affected users where required. eu-digital-services-act.com

6) App Stores & Subscriptions

Subscriptions are billed by the respective app store (Apple/Google) and renew automatically unless canceled in your store settings. Prices and service scopes are displayed in the app.

7) Right of Withdrawal (Consumers)

You have a 14-day right of withdrawal under Sections 312g and 355 of the German Civil Code (BGB). For digital content/digital services, the right of withdrawal may expire early if you (i) expressly consent to the immediate commencement of performance and (ii) confirm your acknowledgment of the loss of the right of withdrawal (details are set out in the separate “Withdrawal Instructions”). 8) Warranty & Liability

We are fully liable for intent, gross negligence, injury to life, body, or health, and under the Product Liability Act. In the case of ordinary negligence, we are liable only for breaches of material contractual obligations (cardinal duties), limited to the foreseeable, typical damage. Gesetze im Internet

9) Data Protection

Your use is also subject to our Privacy Policy.

10) Governing Law & Jurisdiction

German law applies; mandatory consumer protection rules at the place of your habitual residence remain unaffected. For merchants, the place of jurisdiction is our registered office.

11) Changes

We may update these terms to a reasonable extent and will notify you in advance. You may object to or terminate before the changes take effect.
